Stockholm — The Court of Appeal for Upper Norrland has ruled that Yazied Mohamed, an 18-year-old Eritrean migrant, will not be deported following his three-year prison sentence for the rape of 16-year-old Meya Åberg. According to court documents, Mohamed attacked the teenager in a pedestrian tunnel after she missed her bus following a shift at McDonald’s.
While acknowledging that rape is a serious offence, the court held that the assault did not qualify as an “exceptionally serious crime” under Swedish immigration law — a threshold required to revoke refugee protections and impose deportation.
The court cited the “duration” of the assault among its factors, concluding that although the crime warranted prison time, it did not meet the elevated standard for removal from the country.
The decision has sparked public debate in Sweden over the standard for deportation in cases involving migrants-with-refugee status convicted of violent crimes.
